Your privacy and trust are very important to KAAN’AH APARTMENTS AND VACATION RENTALS (hereinafter “KAAN’AH”). Therefore, we want to ensure that you understand how we safeguard the integrity, privacy, and protection of your Personal Data and Sensitive Personal Data, in accordance with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties, its Regulations, and the Privacy Notice Guidelines.

For KAAN’AH, the collection of certain Personal Data is necessary to carry out activities inherent to its business operations. KAAN’AH has the legal and social obligation to implement sufficient legal and security measures to protect the Personal Data collected, for the purposes described in this Privacy Notice.

All of the above is intended to ensure that you maintain full control and decision-making authority over your Personal Data. Therefore, we recommend that you carefully read the following information.

This Privacy Notice will be available to you at all times on the website www.kaanah.com.mx (hereinafter the “SITE”). In the event of any modifications to this Privacy Notice, you will be informed through the procedures described later in this document.

KAAN’AH APARTMENTS AND VACATION RENTALS is legally represented by Ms. Cinthya Coral Naranjo González, an individual with full legal capacity, with address at: Known Address Isla de la Piedra, Unión de Ejidatarios Street s/n, Postal Code 82043, Municipality of Mazatlán, Sinaloa, Mexico.

2. SERVICES PROVIDED BY KAAN’AH (THE “SERVICES”)

For purposes of this Privacy Notice, the SERVICES include, but are not limited to, the following activities carried out by KAAN’AH, either directly or through its agents, promoters, commission agents, or business partners:

  • Rental of ocean-view apartments on a daily, weekly, monthly, or annual basis.

  • Processing and analysis of reservation requests; administration; billing and collection activities; handling of inquiries; delivery, investigation, and invoicing of charges related to reservations; creation of consumption profiles; and enrollment in loyalty programs.

  • Promotion and sale of other services or products, including reservation processing, outsourcing services with suppliers, as well as invoicing, delivery, and collection.

  • Creation and implementation of analytical and statistical processes related to the SERVICES.

  • Any complementary or auxiliary activities related to the SERVICES.

  • Conducting inquiries, investigations, and reviews regarding complaints and/or claims.

  • Contacting you regarding any matter related to the SERVICES.

3. PERSONAL DATA

KAAN’AH will collect from you the information (Personal Data) necessary for the proper provision of the SERVICES, either (i) directly and/or (ii) through its agents, promoters, commission agents, or business partners. Such Personal Data may include, but is not limited to:

Identification Data: Full name; address; marital status; gender; age; place and date of birth; home phone; mobile phone; handwritten or digital signature; corporate name; Federal Taxpayer Registry (RFC); Unique Population Registry Code (CURP); email address; reservation and/or stay dates.

Employment Data: Occupation; position; department; work address; phone; work email; employment references.

Financial Data: Bank card number; expiration date and security code; income level and occupation.

4. PURPOSE OF DATA PROCESSING

The Personal Data you provide will be used for the provision of the SERVICES.

5. DATA TRANSFER

By accepting this Privacy Notice, you expressly authorize KAAN’AH to transfer your Personal Data, to the extent it deems necessary for the provision of the SERVICES, within and even outside the United Mexican States.

KAAN’AH undertakes to use its best efforts to ensure compliance with all legal principles regarding the protection of your Personal Data in connection with such transfers. Likewise, KAAN’AH commits to ensuring that its business partners and third parties respect the terms of this Privacy Notice at all times.

By accepting this Privacy Notice, you expressly authorize KAAN’AH to transfer your Personal Data to:

  • Companies that are part of KAAN’AH’s corporate group, including subsidiaries and affiliates.

  • Loyalty program administrators associated with the SERVICES.

  • Business partners operating jointly with KAAN’AH any software and/or IT infrastructure used as a platform for the SERVICES.

  • Unaffiliated third parties providing auxiliary or complementary services, including data processing companies, marketing service providers, courier services, security and transport companies, advertising agencies, tourism service providers (such as airlines, hotels, car rental companies), entertainment providers, and data storage providers.

  • External consultants for collection management and legal defense, such as collection agencies or external auditors (legal and accounting).

6. MEANS TO EXERCISE ARCO RIGHTS

In accordance with applicable law, you or your duly authorized legal representative may exercise your rights of Access, Rectification, Cancellation, and Opposition (ARCO Rights):

  • Access: Request to know what Personal Data has been collected and stored.

  • Rectification: Request correction of inaccurate or incomplete data.

  • Cancellation: Request deletion of data when applicable.

  • Opposition: Object to the processing of your Personal Data for justified reasons.

Requests must be submitted in writing at the address indicated in Section 10 or by email to kaanahdepartamentos@gmail.com including:

  • Name of the data subject and email for response

  • Proof of identity or legal representation

  • Clear description of the data involved

  • Any additional information to locate the data

KAAN’AH will respond within 20 business days, with implementation (if applicable) within 15 additional business days.

KAAN’AH may deny requests in cases established by law (e.g., lack of identity verification, legal restrictions, or prior fulfillment).

Access to Personal Data will be free of charge, except for justified reproduction or delivery costs.

7. DATA RETENTION PERIOD

Your Personal Data will be retained for as long as the legal relationship remains in effect and until its satisfactory conclusion, unless you request deletion or revoke your consent. Retention will be limited to the minimum necessary period and, once no longer required, data will be securely blocked and subsequently deleted in accordance with legal requirements.

8. USE OF COOKIES

We use cookies to improve our services and display content based on your browsing preferences. Cookies may allow us to personalize content upon return visits.

Our website does not use cookies to obtain personal identification data unless voluntarily provided. You may disable cookies through your browser settings, although doing so may limit certain functionalities.

We may update this Privacy Notice from time to time. Significant changes will be communicated through a prominent notice on the SITE. We encourage you to review this Notice periodically.

13. DATA PROTECTION AUTHORITY

If you consider it necessary, you have the right to file a complaint with the National Institute for Transparency, Access to Information and Personal Data Protection (INAI) regarding any issue related to the protection of your Personal Data.
