2.- SERVICES PROVIDED BY KAAN’AH (THE “SERVICES”). For the purposes of this Privacy Notice, the SERVICES include, but are not limited to, the performance of the following activities by KAAN'AH, either directly or through its agents, promoters, commission agents or business partners: a) The rent, whether daily, weekly, monthly or annual, of apartments with sea views. b) Processing and analysis of reservation requests; administration; collection activities; clarifications; delivery, investigation and billing of charges related to reservations; creation of consumer profiles; e, registration to own loyalty programs; c) Promotion and sale of other services or products, including the processing of reservations; subcontracting of services with suppliers; as well as billing, delivery and collection; d) The creation and implementation of analytical and statistical processes related to the SERVICES; e) The performance of any complementary or auxiliary activity to the SERVICES; f) Make inquiries, investigations and reviews in relation to complaints and/or claims; and g) Contact you for any issue related to the SERVICES.
3.- PERSONAL DATA. KAAN’AH will collect from you information (Personal Data) necessary for the proper provision of the SERVICES, either (i) directly; and/or (ii) through its agents, promoters, commission agents or business partners. Said Personal Data, by way of example, but not limitation, includes the following information: • Identification data: full name; address; marital status; gender; age; place and date of birth; home phone; cell phone (mobile); handwritten or digital signature; Company name; Federal Taxpayer Registry (RFC); Unique Population Registry Code (CURP); email address; reservation and/or stay dates. • Employment Data: occupation; position; area or department; home; phone; work email address; job references. • Asset Data: Bank card number; expiration date and security code; income and occupation level. • Personal References.
4.- PURPOSE OF DATA PROCESSING. The Personal Data that you have provided us will be used to provide the SERVICES. 5.- DATA TRANSFER. By accepting this Privacy Notice, KAAN'AH is expressly authorized to transfer your Personal Data to the extent that it unilaterally deems it necessary for the provision of the SERVICES within and even outside the Mexican Republic. KAAN’AH is committed to making its best efforts to ensure that all legal protection principles regarding the transfer of your Personal Data are met. Likewise, you express your commitment under the same terms so that the terms of this Privacy Notice are respected at all times, by us, by our business partners and by third parties hired by KAAN'AH. In this sense, your acceptance of the terms of this Privacy Notice expressly authorizes KAAN'AH to transfer your Personal Data to:
a) Those companies that are part of the KAAN'AH economic group, including subsidiaries and affiliates of KAAN'AH, for the provision of the service contracted by you; b) Administrators of loyalty programs, which are part of the services contracted by KAAN'AH.; c) Business partners that operate jointly with KAAN’AH, some type of software and/or any computer infrastructure that serves as a platform for the provision of the SERVICES; d) Non-affiliated third parties, providers of auxiliary or complementary services to the SERVICES, including commission agents; data processing companies; companies sending marketing material (print or electronic); courier, security and value transport companies; advertising agencies; tourism service providers (such as airlines, hotels, car rental companies); entertainment service providers; information custody and storage companies (physical or electronic media), with the purpose of assisting them in the provision of the SERVICES; and e) External consultants for the purpose of collection administration related to the SERVICES, and to defend KAAN'AH from any legal controversy that arises due to the provision of the SERVICES, such as collection agencies or external auditors (legal and accounting).
6.- MEANS TO EXERCISE ARCO RIGHTS. In accordance with the Federal Law on Protection of Personal Data Held by Private Parties, the Owner, by himself or through a duly accredited legal representative, may exercise his rights of access, rectification, cancellation and opposition (ARCO Rights), directly before the Special Protection Unit. Attention to Privacy. (i) ACCESS: You may request at any time to know what data of yours has been collected and kept by KAAN'AH; (ii) RECTIFICATION: If any of your data is inaccurate or incomplete, you may request its correction, and must attach the documentation that proves said modification; (iii) CANCELLATION: The cancellation of data may be requested at any time; If the request is appropriate, the data will enter the blocking period in which they cannot be processed in any way for subsequent deletion; and (iv) OPPOSITION: At any time the Owner may refuse for justified cause the processing of his/her Personal Data. You or, where applicable, your legal representative, may exercise the Rights of Access, Rectification, Cancellation and Opposition (ARCO Rights), provided for in the Federal Law on Protection of Personal Data Held by Private Parties.
6.1.- The request for access, rectification, cancellation or opposition must be submitted in writing to the address referred to in section 10 (ten) of this Privacy Notice, or sent by email to the address Gestión@kaanah.com .mx, and accompany the following: The name of the Owner and email address, to communicate the response to your request; Documents that prove the identity or, where applicable, the legal representation of the Owner; The clear and precise description of the Personal Data with respect to which one seeks to exercise any of the ARCO Rights; and Any other element or document that facilitates the location of Personal Data.
6.2.- Only when each and every one of the requirements referred to in the immediately preceding paragraph are met, KAAN'AH will process the requests for the exercise of the rights referred to in the Federal Law on Protection of Personal Data Held. of the Individuals. 6.3.- In the case of requests for rectification of Personal Data, the Owner must indicate, in addition to what is stated above, the modifications to be made and provide the documentation that supports their request. 6.4.- KAAN'AH will inform the Owner, within a maximum period of 20 (twenty) days, counted from the date on which the request for access, rectification, cancellation or opposition was received, the determination adopted, to the effect that, if is appropriate, it is made effective within fifteen business days following the date on which the response is communicated. In the case of requests for access to Personal Data, delivery will proceed, after accreditation of the identity of the applicant or legal representative, as appropriate.
6.5.- The aforementioned deadlines may be extended only once for an equal period of time, as long as the circumstances of the case justify it, at the discretion of KAAN'AH. 6.6.- The obligation to access information will be considered fulfilled when it is made available to the Owner of the Personal Data; or, by issuing simple copies, electronic documents or any other means determined by KAAN'AH. 6.7.- KAAN'AH may deny access to Personal Data, rectify it, cancel it or grant opposition to its processing, in the following cases: a) When the applicant is not the Owner of the Personal Data, or the legal representative is not duly accredited to do so; b) When the Personal Data in question in the request is not found in its database; c) When the rights of a third party are violated; d) When there is a legal impediment, or the resolution of a competent authority, that restricts access to Personal Data, or does not allow rectification, cancellation or opposition thereof; and e) When the rectification, cancellation or opposition has been previously carried out.
6.8.- The refusal referred to in this section may be partial, in which case KAAN'AH will carry out the access, rectification, cancellation or opposition required by the Owner. 6.9.- In all the above cases, KAAN'AH must inform the reason for its decision and communicate it to the Owner, or, where appropriate, to the legal representative, within the deadlines established for this purpose, by the same means by which it was carried out. carry out the request, accompanying, where appropriate, the elements it deems appropriate. 6.10.- The delivery of Personal Data will be free of charge, and the Owner must cover only the justified shipping costs, cost of reproduction in copies and other formats.
